These terms cover your use of the Prevail website and the early access programme. Prevail is not yet generally available, so much of what follows is about what we are and are not promising while the product is still being built.
Agreeing to these terms
By using this site or submitting a request for early access, you agree to these terms. If you are doing so for a company, you confirm you are authorised to act on its behalf. If you do not agree, please do not use the site.

What Prevail is right now
Everything on this site describes a product in development. Screens, metrics and results shown in the preview are illustrative, use sample data, and are not a representation of results you will achieve. We may change, delay or abandon any feature described here.
Early access and the design partner programme
Requesting access does not create a contract to supply the product. We choose who joins the programme and may decline or withdraw access at our discretion. Where we do grant access, it is provided free of charge unless we agree otherwise in writing, and it may be suspended or ended at any time.
Acceptable use
You agree not to:
- Use the site or any preview in breach of applicable law
- Attempt to gain unauthorised access to our systems, or probe, scan or test their security
- Scrape, copy or republish substantial parts of the site
- Submit false information, other people's personal data without a lawful basis, or anything malicious
- Interfere with the availability of the service for others
Confidentiality and feedback
If we give you access to unreleased features, roadmap detail or pricing, treat it as confidential and do not share it publicly without our permission.
If you send us feedback, ideas or suggestions, we may use them to improve the product without restriction or payment. You keep any rights you already had in the underlying material; you are simply not charging us for acting on the suggestion.
Intellectual property
The site, its content, the Prevail name and the Prevail logo belong to us or our licensors. These terms do not transfer any of those rights to you. Brand assets published on our brand page may be used only as described there.
No warranties
The site and any early access are provided “as is” and “as available”. We do not warrant that they will be uninterrupted, error free, or that any output, recommendation or ranking produced by the product is accurate or suitable for your decisions. You remain responsible for the business decisions you make.
Limitation of liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. Subject to that, we are not liable for loss of profits, revenue, data, goodwill or business opportunity, or for any indirect or consequential loss, arising from your use of the site or early access. Our total liability in connection with these terms is limited to [PLACEHOLDER: cap, e.g. £100] where access has been provided free of charge.
These terms are aimed at business users. If you are a consumer, your statutory rights are not affected.

Governing law
